What is Workers’ Compensation?

Workers’ compensation is a government-mandated insurance that employers must provide to their employees, which will pay a monetary benefit if an employee is injured at work, or if they become sick due to their job. Workers’ compensation also provides payments to employees to help cover their wages if they are not fit for work, and will also provide a benefit to cover costs of medical expenses and rehabilitation. The federal government was the first employer to ensure their workforce was covered, when legislation passed in 1908 that provided worker’s compensation coverage for federal employees. The majority of states adopted workers’ compensation laws between 1911 and 1920. Almost thirty years later, the last state to adopt worker’s compensation laws was Mississippi in 1948

What makes you eligible for Workers’ Compensation?

There are four standard eligibility requirements for workers’ compensation benefits, which are:

  • You must follow the state rules and deadlines when filing a workers’ compensation claim

The threat always exists that some people will attempt to collect benefits by faking, or exaggerating an illness or injury. In fact, fraudulent worker’s compensation claims have risen substantially in the United States over the past few years, due to poor economic conditions. Some individuals who may be struggling to make ends meet may claim an illness with an employer, but have another job on the side. This, or any other type of workers’ compensation fraud, carries penalties that can be very severe.  

How much does Workers Compensation cost employers?

Even if they aren’t legally required to do so, many employers will still purchase workers’ compensation insurance. Most states’ laws allow exempt employers to “opt in” to the workers’ compensation system. The reason many employers, who are not required to provide workers’ compensation coverage to their employees, will do so anyway is to help with employee retention, since it allows an employee to receive benefits for work-related injuries, and because the employee will not be able to file a lawsuit against the employer. Employers will commonly purchase workers’ compensation insurance through a private insurance company, however, in some states a state fund is available. Large employers, as well as state and local governments, will choose to self-insure; meaning that they will assume the financial risk for payment of the workers’ comp benefits. For a private company, workers’ compensation cost the employer an average of $37 per hour worked in 2021. Wage and salary costs averaged $26 per hour, and accounted for 71 percent of employer costs, while benefit costs averaged $11, accounting for the remaining 30 percent.
